Pennsylvania – Scranton and Wilkes-Barre – Birth Injury Attorneys – Social Security Assistance

Birth injury can lead to a number of disabilities that can leave the family and child with overwhelming financial, medical, and emotional burdens for years to come. From traumatic brain damage to cerebral palsy, birth injuries can saddle you and your child with a lifetime of strain and adjustment. Our law firm serves Scranton, Wilkes-Barre, and all of Pennsylvania with experienced birth injury attorneys who can help people get the benefits they deserve. Regardless of the cause of your child’s birth injury, Social Security disability assistance is available to help relieve your family.

Social Security Assistance

The Social Security Administration offers cash benefits to families caring for children with special needs. If your child is suffering from a birth injury that will last for at least a year, your family may be eligible to receive Social Security assistance.

Disabled Children

Children under age 18 can qualify to receive monthly Social Security payments if they meet federal child disability requirements and their family’s financial resources fall below certain limits. If your child has suffered from a birth injury that resulted in a mental or physical condition that will prevent him or her from working for at least 12 months, or that will cause death, your child could qualify to receive cash benefits from the Supplemental Security Income program.

Disabled Adult Child

Adults who became disabled before age 22 may be eligible to receive assistance under the Social Security Disability Insurance program. This adult “child’s” benefit requires that one of the child’s parents must be receiving Social Security retirement or disability benefits, or that a parent has worked long enough under the Social Security system to be eligible for disability benefits. Social Security Disability Insurance lasts as long as the child remains disabled.

Contact O'Malley & Langan, P.C., serving all of Pennsylvania, including Wilkes-Barre and Scranton; our birth injury attorneys can help you get the Social Security benefits you deserve in a timely manner.

Cerebral Palsy

One of the most common congenital birth defects is cerebral palsy, which comprises a number of disorders that involve impaired muscle control stemming from damage in the part of the brain that regulates muscle movement. Cerebral palsy can be caused by a lack of oxygen to the brain during labor, a head injury from the use of excessive force during delivery, or other factors. Symptoms include muscle disorders, paralysis, seizures, mental retardation, blindness, learning disabilities, and more.

Certain medical conditions, of which cerebral palsy is an example, are considered severe enough for the Social Security Administration to grant Supplemental Security Income to a family for up to three months while officials decide if the child qualifies for disability relief. If your child has cerebral palsy, you may be able to receive cash benefits immediately. Contact our Pennsylvania birth injury attorneys today.
